sometimes soundtracks are licensed for a film in a buyout, so as long as it is synched with the film, it is PD. But if you just take the soundtrack and use it alone, you might have copyright issues.

Okay... show of hands... who thinks if I take the sound track and animate new visuals... am I in copyright infringement regarding the sound track?

I wouldn't worry. It's just FUD. The PD license is clear.

No. The PD license is not clear. I wish it was. The current state of law and its enforcement is a mess.

If you're not making money off it or blasting it all over the web, it's probably not such a big issue. But it's true that just because a film is PD doesn't necessarily mean the soundtrack by itself is also. I'm no expert, however.

I WAAAS considering on making money...

example... for the past 3 years, I have been enhancing LOSTWORLD... literally shot by shot cleaning it up and adding background to the left and right of the shots to make it widescreen...

heck... even redoing some of the shots altogether, clipping the individual characters, making a new background and placing them back into the shot...

Its a very slow process... eventually it will be done... oh yes... it will be done.

If you produce new content, and produce a brand-new soundtrack for the silent film, and newly-worded subtitles, you're good to go, I think. The big problem here is the literary rights. Research.

It's rare, but there have been instances where the owner of the music in an old PD film went after a PD DVD seller.

Ask Video Cellar. He's the real expert on issues like this. Better to be safe than sorry.
